El convenio regulador en la separación y divorcio notariales naturaleza, contenido y límites
Tras la reforma operada por la Ley de Jurisdicción Voluntaria, el convenio regulador es un requisito necesario para que se pueda autorizar la escritura de separación o divorcio ante notario. Dentro del contenido, no conviene incluir aquellos negocios jurídicos patrimoniales que no entren en el ámbito de la liquidación del régimen económico matrimonial. Estos negocios, al tener su propia causa, sería más apropiado documentarlos en escritura separada o en una cláusula diferenciada de la propia escritura que incorpore el convenio y deben liquidarse por el impuesto que corresponda al negocio jurídico escogido.
Following the reform brought into effect by the Voluntary Jurisdiction Act, the regulating agreement is a necessary requirement in order to authorise the deed of separation or divorce before a Notary. In the content of the agreement it is not appropriate to include that legal business property that does not fall within the scope of the liquidation of the marital assets. These businesses that have their own object would be more appropriate to document in writing or in a separate clause separate from the deed to incorporate in the agreement and must be settled taking into account the taxes of the particular business.
