Cuando los defectos de técnica legislativa provocan que una norma bien intencionada termine generando inseguridad
El artículo 98.3 de la Ley 7/2022 impone con ocasión de una transmisión declarar si se han realizado actividades contaminantes en la finca declaración de la que se debe dejar constancia en el Registro mediante nota marginal. La norma es criticable porque impone al transmitente una declaración sin límite temporal ni subjetivo (“si se ha realizado o no…”) lo que de interpretarse de forma literal y rigurosa conducirá a declaraciones en vacío con el peligro de incurrir en responsabilidad por ignorancia de lo realizado por los anteriores propietarios de la finca. Por otro lado se dispone que esa declaración sobre la cual no existe ninguna garantía de veracidad se traslade al Registro de la Propiedad mediante nota marginal. Por ello se propone una interpretación restrictiva para atenuar los perniciosos efectos que la norma puede generar para la seguridad del tráfico jurídico.
Article 98.3 of Law 7/2022 stipulates that a compulsory declaration must be made regarding whether polluting activities have been carried out on a property when ownership of it is transferred. The declaration must be recorded in the Register by means of a marginal note. The legislation is open to criticism because it makes a declaration with no timeframe or subjective limitation ("whether... has been carried out or not…") compulsory for the transferring party. If interpreted literally and rigorously this would lead to meaningless declarations with the danger of liability due to ignorance of the actions of previous owners of the property. It also stipulates that this declaration of which the veracity is not guaranteed must be notified to the Land Registry Office by means of a marginal note. A restrictive interpretation is therefore proposed to mitigate the harmful effects that the legislation could have on the security of legal transactions.
