El delito de agresión sexual. Reflexión con ocasión de la Ley orgánica 10/2022, de 6 de septiembre, de garantía integral de la libertad sexual
Reflexión sobre los últimos acontecimientos jurídicos en torno a la regulación del delito de agresión sexual, tras la aprobación de la Ley Orgánica 10/2022, de 6 de septiembre, de garantía integral de la libertad sexual, que ha determinado dos grandes modificaciones en la regulación jurídico-penal de este fenómeno delictivo: la desaparición de la diferencia entre agresiones y abusos sexuales, reduciéndose a una sola conducta típica “agresión”, a través de cualquier atentado a la libertad sexual del sujeto pasivo “sin su consentimiento”; y la concreción de la forma que debe revestir el consentimiento en el ámbito de las relaciones sexuales “que exprese de manera clara la voluntad de la persona”, lo que nos ha llevado a analizar el papel que tiene ahora el consentimiento y los problemas que ha planteado la prueba del mismo.
Reflection on the latest legal events regarding the regulation of the crime of sexual assault, after the approval of Organic Law 10/2022, of September 6, on the comprehensive guarantee of sexual freedom, which has determined two major modifications in the regulation legal-criminal of this criminal phenomenon: the disappearance of the difference between assaults and sexual abuses, being reduced to a single typical conduct "aggression", through any attack on the sexual freedom of the passive subject "without their consent"; and the specification of the form that consent must take in the field of sexual relations "that clearly expresses the will of the person", which has led us to analyze the role that consent now has and the problems that it has raised its proof.
